Welcome to the global connectivity platform SimSIM, operating at the web address simsimglobal.com (the "Site"). The Site is operated by Nadav Shevy, an exempt dealer (osek patur) registered in Israel, trading under the name "SimSIM" (the "Site Operator"). The Platform provides advanced communication solutions through the purchase of data packages based on eSIM technology for international use.

This Agreement is a legally binding contract in all respects. Continuing to browse, accessing content, or purchasing products on the Site constitutes your express declaration that you have read, understood, and agreed without reservation to all of the terms set out below. For convenience only, this document is drafted in one grammatical gender, but it addresses and binds all genders equally.


Part A: Threshold Conditions and User Obligations

1. Eligibility, Registration, and Activity Security

  • Contractual eligibility: Purchasing and using the Site's services is permitted only for users aged 18 and over, with full legal capacity, holding a legal and valid means of payment approved by the Site Operator.
  • Accuracy of information: The user undertakes that all details and personal data provided during the purchase or registration process (including full name, email address, and billing details) will be correct, accurate, and complete.
  • Use restriction: Use of the Site and the services offered on it is intended for personal purposes only. Resale, commercial distribution, wholesale marketing, or any other commercial use of the products is strictly prohibited without a written commercial agreement signed in advance with SimSIM.

2. Prohibited Activities and Technical Restrictions

The Site Operator reserves the right to immediately block access for users who violate the following rules:

  1. Uploading, distributing, or injecting malicious software, hostile code, viruses, or Trojan horses into the Site's systems is prohibited.
  2. Using robots, automated crawlers, or data-mining tools to copy content, prices, or information from the Platform is prohibited.
  3. Performing actions that place an unreasonable load on the Site's servers, or that attempt to compromise the security of the system, is strictly prohibited.

Part B: Delivery Process, Nature of the Service, and Technological Limitations

3. Product Delivery Mechanism and Hardware Compatibility

  • Method of delivery: Upon completion of the purchase process and receipt of final confirmation from the payment provider, the Site's system will automatically and immediately send a unique QR code to the email address entered by the customer. Detailed installation and activation instructions will be attached to the code.
  • Responsibility for hardware compatibility: The customer bears sole and full responsibility for checking and verifying, before placing the order, that their mobile device technologically supports eSIM components and that the device is open for use on all networks (not locked or blocked by any cellular operator).

4. Service Definition (Data Only) and Prevention of Roaming Charges

  1. Data traffic only: The eSIM packages sold on the Site are intended for data and browsing only. The service does not include a regular phone line, a local or international number, and does not support making or receiving GSM voice calls or SMS messages. The user may run network-based applications (such as WhatsApp, Telegram, etc.) over the internet connection.
  2. Prevention of excess charges: It is the traveler's sole responsibility to ensure that their primary home SIM card is turned off and/or that data roaming for that card is blocked while abroad. Failure to make these settings may result in substantial charges from the user's home cellular provider, and SimSIM will bear no responsibility for such damages or charges.

5. Communication Networks and Technical Refund Policy

  • Reliance on third parties: The data services are based on and provided over the infrastructure and networks of local operators in the destination countries. Because SimSIM does not own the physical network, it is not responsible for reception disruptions, low speeds, restrictive geographic conditions, or local network congestion abroad.
  • Exclusion of credits: No refund or compensation will be given in cases of purchase for a device that does not support the technology, a device locked to networks, incorrect device settings made by the user, or local infrastructure problems in the destination country. Exceptional inquiries will be considered as a gesture of goodwill only and at the sole discretion of the Site's management. In the event of a fault, the customer must contact technical support immediately and in real time through the Site's help center.

Part C: Financial Aspects, Cancellation of Transactions, and Consumer Protection Law

6. Prices, Taxation, and Transaction Confirmation

  • Currency of activity: All prices shown on the Site are quoted in New Israeli Shekels (₪), unless otherwise expressly stated in writing.
  • Taxes: The Site Operator is registered in Israel as an exempt dealer (osek patur) and therefore does not charge Israeli Value Added Tax (VAT). The prices shown are the final prices, and no VAT is added at checkout. The Operator issues a receipt for each purchase (rather than a VAT tax invoice). Should the Operator's status change to a VAT-registered dealer (osek murshe), VAT will be added and charged in accordance with Israeli law, and this Section will be updated accordingly.
  • Transaction maturity: A purchase will be deemed approved and binding only after receiving final confirmation from the payment provider and the issuance of an official order confirmation by SimSIM's systems.

7. Cancellation and Refund Policy

In short: you can cancel and get a refund within 14 days of purchase as long as the eSIM has not been activated. Once the eSIM is activated, it is treated as consumed and is no longer refundable — except where you have a legal right to a remedy because the service is faulty or not as described.

7.1 What "activated" (consumed) means

For the purposes of this policy, an eSIM is considered activated and consumed at the earliest of the following: (a) the QR code has been scanned; (b) the eSIM profile has been installed or downloaded onto a device; or (c) any data has been used on the package. Because an eSIM is a digital product that is single-use once installed, activation cannot be reversed.

7.2 Refunds before activation (14-day right)

In accordance with the Consumer Protection Law, 5741-1981, you may cancel your purchase and receive a refund within 14 days of the date of the transaction (or of receiving the transaction disclosure document, whichever is later), provided the eSIM has not been activated as described in Section 7.1. To the extent permitted by law, a cancellation that meets these conditions may be subject to a cancellation fee of 5% of the transaction total or ₪100, whichever is lower.

7.3 No refund after activation

Once the eSIM has been activated (Section 7.1), the digital product is deemed fully supplied and consumed, and the purchase is not refundable, whether in whole or in part and regardless of how much data has actually been used. This reflects the exemption under the Consumer Protection Law for information/digital products that have been opened or consumed. This Section does not limit your rights under Section 7.5 below.

7.4 Customers in the EU/EEA and the United Kingdom

If you are a consumer in the EU/EEA or the UK, you have a statutory right to withdraw from a distance contract within 14 days. However, because the eSIM is digital content supplied without a tangible medium, at checkout you will be asked to expressly consent to the eSIM being made available for immediate activation and to acknowledge that, by activating it, you lose your right of withdrawal. If you provide that consent and then activate the eSIM, your 14-day withdrawal right no longer applies. If you do not activate the eSIM, your 14-day withdrawal right is preserved.

7.5 Faulty or misdescribed service

Nothing in this policy affects your statutory rights where the service is defective, does not work as described, or is otherwise not of the quality required by applicable law. If the eSIM fails to function due to a fault attributable to SimSIM (and not to the excluded causes in Section 5, such as an incompatible or network-locked device, incorrect device settings, or local network conditions in the destination country), please contact support promptly and we will investigate and, where appropriate, provide a replacement, credit, or refund as required by law.

7.6 How to request a refund

To request a cancellation or refund, contact us through the Site's help center or at support@simsimglobal.com with your order details. Where a refund is due, it will be issued using the original payment method within the timeframe required by law (and in any event no later than 14 days from our acceptance of a valid cancellation), and any associated charge will be cancelled or reversed accordingly.

7.7 Purchases made through app stores

If you purchased through the Apple App Store or Google Play, refunds for that purchase may also be subject to the relevant store's own refund policies and processes, in addition to your statutory rights.


Part D: The Loyalty Program and Customer Benefits (SimSIM Coins)

8. Accrual Mechanism (Tiered Cashback)

The SimSIM Coins program is a virtual loyalty program granted as a benefit to registered users only. Accrual is based on a certain percentage of the order's "qualifying base" (the final price actually paid after discounts and coupons, and before the redemption of existing coins in that transaction). The accrual percentage is determined according to the customer's total cumulative spend on the Site:

  • Tier 1 — cumulative purchases up to ₪100: 2% Cashback
  • Tier 2 — cumulative purchases from ₪100 to ₪250: 3% Cashback
  • Tier 3 — cumulative purchases of ₪250 and above: 5% Cashback

Note: SimSIM reserves the right to update or change the accrual tiers, percentages, and program terms at any time, and any change will be published on the Site and will apply from that point onward.

9. Referral Program and Coin Redemption

  • Referring friends: Each registered user receives a personal referral link/code. A referral code is eligible only on orders with a minimum value of 5 USD; orders below this amount do not qualify. When a new user signs up through your referral, purchases a qualifying eSIM package (5 USD or more), and activates it, you (the referrer) will be credited with 2 SimSIM Coins. Coins are credited only after the referred purchase has been activated; referrals that are cancelled or never activated do not qualify. Credited coins become available to use 14 days after the referred eSIM has been activated.
  • Redemption conditions: Accrued coins may be redeemed as a direct discount at checkout. There is no minimum balance required to redeem, and coins may be used to cover part or all of a transaction.
  • No expiry: SimSIM Coins do not expire and remain available in your account for as long as your account is active.
  • Effect of transaction cancellation: In the event of a transaction cancellation, coins accrued for it will be deducted from the account balance. If coins were used to pay for the cancelled order, the redeemed coins will be returned to the customer's account balance.
  • Program changes: SimSIM may update the referral bonus, redemption rules, and other program terms from time to time; any change will be published on the Site and will apply from that point onward.
  • Legal status: SimSIM Coins have no actual monetary value, and they cannot be converted to cash or transferred between different accounts. Misuse or attempted manipulative accrual will lead to cancellation of the coins and closure of the account.

Part E: General Provisions, Intellectual Property, and Legal Jurisdiction

10. Intellectual Property and Data Protection

  • Ownership of assets: All copyrights, trademarks, graphic designs, texts, source code, and patents on the Site belong exclusively to SimSIM or to third parties who have granted it a license to use them. These assets may not be copied, distributed, or used commercially without express written permission.
  • Privacy and cookies: The collection of information on the Site is governed by the Company's separate Privacy Policy. The Site uses cookies for operation, security, and content tailoring, and continued use of the Site constitutes consent to this.

11. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, the Site Operator disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Because the service relies on third-party cellular networks (Section 5), the Operator does not warrant that the service will be uninterrupted, error-free, secure, or available at any particular speed, coverage level, or location. Nothing in this Section limits any warranty or right that cannot be excluded under applicable consumer law (see Section 15).

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  1. The Site Operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for roaming or other third-party charges incurred by the user (see Section 4).
  2. The Site Operator's total aggregate liability arising out of or relating to the service or these Terms will not exceed the amount actually paid by the user for the specific eSIM package giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under mandatory consumer-protection law (see Section 15).

13. Force Majeure

The Site Operator will not be considered in breach of these Terms, nor liable for any delay or failure to perform, where this is caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, civil unrest, strikes, failures or congestion of telecommunications or internet infrastructure, acts or omissions of local network operators, government action, or outages of third-party service providers.

14. Changes to These Terms

The Site Operator may amend these Terms from time to time — for example, to reflect changes in the service, in business or payment practices (including a change of tax status from osek patur to osek murshe), or in legal requirements. The updated Terms will be posted on the Site with a revised effective date. For material changes, the Operator will take reasonable steps to notify registered users (for example, by email or an on-site or in-app notice). Changes take effect from the date the updated Terms are posted and apply going forward only; they will not apply retroactively to a purchase already completed before the change. Your continued use of the Site or services after the updated Terms take effect constitutes acceptance of them.

15. Consumers in the EU/EEA and the United Kingdom

If you are a consumer, you benefit from any mandatory protections of the consumer-protection laws of your country of residence, and nothing in these Terms removes or limits any right that cannot be waived under those laws. In particular, if you are a consumer resident in the EU/EEA or the United Kingdom:

  1. The governing-law and jurisdiction provisions in Section 16 do not deprive you of the protection afforded by mandatory provisions of the law of your country of residence, and you may be entitled to bring proceedings in your local courts where local law so provides.
  2. The disclaimer of warranties (Section 11) and the limitation of liability (Section 12) apply only to the extent permitted by the mandatory consumer law that applies to you.

16. Miscellaneous, Assignment of Rights, and Governing Law

  • Official notices: Any notice sent to the customer by email will be deemed to have reached its destination within 24 hours of the time of sending. The Site Operator may assign or transfer its rights and obligations under this Agreement to a third party at any time (such as in the case of a merger or sale of operations), provided that the user's rights are not impaired.
  • Governing language: These Terms are drafted in English, which is the governing language of the agreement.
  • Governing law and jurisdiction: This Agreement, its interpretation, and any legal dispute arising from it shall be governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Jaffa shall have jurisdiction — in each case subject to the mandatory consumer protections described in Section 15.
